<div class="documentDescription"><p>The Catskill Litigation Trust is pursuing over $5 Billion in judgment and litigation claims against Harrah’s Operating Company, Inc. ("Harrah's") and other persons on behalf of a large number of beneficiaries of the Trust. The Trust has been registered as a public entity with the U.S. Securities & Exchange Commission since January 2004.</p><span style="font-weight: normal;"><p>The Trust’s judgment and litigation claims against Harrah’s relate back to the intentional interference on April 14, 2000, by Harrah’s predecessor, Park Place Entertainment Corporation, with the development of a Native American casino project by predecessors of the Trust at the Monticello Raceway, Sullivan County, in the Catskills Mountains of New York.</p><p>Park Place merged with Harrah’s in June 2005, and Harrah’s assumed all litigation liabilities of Park Place. Harrah’s is currently the sole corporate defendant by virtue of being the surviving corporation in its merger with Park Place.</p></span></div>

On June 26, 2008, the U.S. Court of Appeals for the 9th Circuit ruled against Harrah's Operating Company, Inc. in a contract interference suit and upheld a development company's claim that its gaming-related agreements with an Indian tribe were valid before the land on which gaming was to be operated was transferred to the U.S. in trust for the benefit of the Tribe.
