Ninth Circuit decision bolsters Catskill Litigation Trust Second Circuit appeal
On June 26, 2008, the U.S. Court of Appeals for the 9th Circuit ruled against Harrah's Operating Company, Inc. in a contract interference suit and upheld a development company's claim that its gaming-related agreements with an Indian tribe were valid before the land on which gaming was to be operated was transferred to the U.S. in trust for the benefit of the Tribe. The The Catskill Litigation Trust made the same argument in the appeal presently pending before the 2nd Circuit.
