The Trust’s beneficiaries presently include:

• 12,240 enrolled members of the St. Regis Mohawk Tribe (“Tribe”).
• Hundreds of former public shareholders of Empire Resorts, Inc. (NASDAQ: NYNY), which was a part owner of several of the predecessors of the Trust.
• A group of private development companies and their investors who were working to develop the Casino Project from 1995-2000 and whose interests relating to the Casino Project were merged into Empire Resorts, Inc. in January 2004.
